Terms of Service for Decidr

Important: By downloading, installing, or using Decidr, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the app.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Decidr ("we," "us," or "our") regarding your use of the Decidr mobile application (the "App"). By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Description of Service

Decidr is a decision-making assistance application that provides various randomization tools including:

Coin flip
Dice roller
Lucky wheel
Magic 8-Ball
Yes/No/Maybe decision maker
Number generator
Name picker
Custom list randomizer
And other decision-making tools

The App also includes features for tracking decision history, maintaining usage streaks, and earning achievements.

3. Disclaimer of Decision-Making Responsibility

IMPORTANT DISCLAIMER: Decidr is an entertainment and productivity tool designed to help you make decisions through randomization. However:

You are solely responsible for all decisions you make, whether or not they are influenced by the App
The App should NOT be used as the sole basis for important life decisions, medical decisions, legal decisions, financial decisions, or any decisions with serious consequences
Results generated by the App are random and should be treated as suggestions, not definitive answers
We assume no responsibility or liability for any decisions made using the App or their outcomes

4. Eligibility and User Conduct

4.1 Age Requirements

The App is suitable for users of all ages. However:

Users under 13 years of age should use the App only with parental guidance and consent
Parents and guardians are responsible for monitoring their children's use of the App

4.2 Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

Use the App for any illegal or unauthorized purpose
Attempt to reverse engineer, decompile, or disassemble the App
Use the App in any way that could damage, disable, or impair the App
Attempt to gain unauthorized access to any portion of the App
Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices
Use the App to make decisions that could harm yourself or others

5. Intellectual Property Rights

5.1 Ownership

The App and all content, features, and functionality (including but not limited to all information, software, code, text, displays, graphics, photographs, video, audio, design, presentation, selection, and arrangement) are owned by Decidr, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

5.2 License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile device solely for your personal, non-commercial use.

5.3 Restrictions

You may not:

Copy, modify, or create derivative works of the App
Distribute, transfer, sublicense, lease, lend, or rent the App
Use the App for any commercial purpose
Remove or alter any copyright, trademark, or other proprietary notices

6. User-Generated Content

6.1 Your Content

You retain ownership of any content you create within the App, including:

Custom lists
Questions entered into decision tools
Custom wheel options
Any other user-generated content

6.2 Privacy

All user-generated content is stored locally on your device. We do not have access to, collect, or store any of your content. Please refer to our Privacy Policy for more information.

6.3 Content Responsibility

You are solely responsible for the content you create and enter into the App. You agree not to create or input content that:

Is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene
Violates any third party's rights, including intellectual property rights
Contains viruses or other harmful code

7. Updates and Modifications

7.1 App Updates

We may, from time to time:

Release updates, upgrades, or new versions of the App
Add, modify, or remove features
Change the App's functionality

You may need to update the App to continue using it. We recommend enabling automatic updates on your device.

7.2 Terms Updates

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

Updating the "Last Updated" date
Providing an in-app notification

Your continued use of the App after changes constitute acceptance of the updated Terms.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability, fitness for a particular purpose, or non-infringement
Warranties that the App will be uninterrupted, error-free, or free of viruses or other harmful components
Warranties regarding the accuracy, reliability, or completeness of any information or results provided by the App

WE DO NOT WARRANT THAT:

The App will meet your requirements or expectations
The App will be available at all times
Defects will be corrected
The App is free from bugs, errors, or other limitations

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DECIDR, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Any loss of profits, revenue, data, or use
Any damages arising from your use or inability to use the App
Any damages related to decisions made using the App
Any damages resulting from unauthorized access to your device or data

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Indemnification

You agree to defend, indemnify, and hold harmless Decidr, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

Your use of the App
Your violation of these Terms
Your violation of any third-party rights
Any decisions made using the App

11. Third-Party Links and Services

The App may contain links to third-party websites or services that are not owned or controlled by Decidr. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by or in connection with the use of any such content, goods, or services.

12. Termination

12.1 By You

You may stop using the App at any time by uninstalling it from your device.

12.2 By Us

We reserve the right to terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

12.3 Effect of Termination

Upon termination:

Your right to use the App will immediately cease
You should delete the App from your device
All locally stored data will be deleted when you uninstall the App

13. Export Controls

The App may be subject to export control laws and regulations. You agree to comply with all applicable export and import control laws and regulations in your use of the App.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of your jurisdiction, without regard to its conflict of law provisions.

14.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or the App shall be resolved through:

Informal Negotiation: First attempt to resolve the dispute informally by contacting us
Mediation: If informal negotiation fails, the dispute may be submitted to mediation
Legal Action: As a last resort, disputes may be resolved through legal proceedings

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by us.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Decidr regarding the App and supersede all prior agreements and understandings.
